TERMS OF SERVICE

Effective date: 01/07/2026
Last updated: 01/07/2026

These Terms of Service (“Terms”) govern your access to and use of the LUMA website, including any purchases made through the website.

The website is operated by Backlight Digital Solutions SL, trading as LUMA (“LUMA”, “we”, “us” or “our”).

Our registered address is:

C/Mirador Encamp 16 , AD200, Andorra

Company registration number: 715622K
Contact email: support@luma.com

By visiting our website, placing an order or otherwise using our services, you agree to be bound by these Terms. Please read them carefully before using the website.

Nothing in these Terms limits or excludes any mandatory consumer rights that apply to you under the laws of your country of residence.

1. Eligibility

You must be at least 18 years old, or have reached the legal age required to enter into a binding contract in your country, to place an order through our website.

By placing an order, you confirm that:

  • The information you provide is complete and accurate.

  • You are legally authorised to use the selected payment method.

  • You are purchasing the products for lawful personal or business use.

  • Your order does not violate any applicable law or regulation.

We may refuse or cancel an order where we reasonably believe that the order is fraudulent, unauthorised, unlawful or intended for resale without our permission.

2. Products and Product Information

We make reasonable efforts to ensure that product descriptions, photographs, specifications, dimensions, features, colours and other information displayed on our website are accurate.

However, product colours and appearance may vary slightly depending on screen settings, lighting conditions, manufacturing variations and product updates.

Packaging, accessories and minor design details may occasionally differ from the images shown without affecting the product’s essential characteristics or functionality.

All products are subject to availability. We reserve the right to discontinue, update or modify products at any time, provided that such changes do not affect orders that have already been accepted.

3. Product Use and Safety

You are responsible for reading and following all instructions, warnings and safety information supplied with the product.

LUMA lighting products must be installed, charged, stored and used only as directed. You must not:

  • Modify, dismantle or attempt to repair the product unless expressly authorised.

  • Expose the product to water, excessive heat, fire or unsuitable environmental conditions.

  • Use damaged charging cables, batteries or components.

  • Install the product on an unstable or unsuitable surface.

  • Use the product for a purpose for which it was not designed.

LUMA products are intended to provide convenient supplementary lighting. Unless expressly stated otherwise, they are not designed to replace permanent electrical lighting, emergency lighting, security systems, fire-safety equipment or other legally required safety installations.

Keep products and removable components away from young children where they may create a choking, electrical or other safety risk.

Improper installation, charging, modification or use may damage the product and could result in personal injury or property damage.

4. Orders and Contract Formation

The presentation of products on our website is an invitation to place an order and does not constitute a binding offer from us.

After submitting an order, you will normally receive an email confirming that we have received it. This acknowledgement does not necessarily mean that the order has been accepted.

A binding sales contract is formed when we:

  • Send you an order confirmation indicating that your order has been accepted; or

  • Dispatch the products, whichever occurs first.

We reserve the right to reject or cancel an order before dispatch for reasons including:

  • Product unavailability.

  • Incorrect pricing or product information.

  • Suspected fraud or unauthorised payment.

  • Delivery restrictions.

  • An obvious technical or typographical error.

  • Quantity limitations or suspected unauthorised resale.

  • Legal or regulatory restrictions.

If we cancel an order after payment has been taken, we will refund the relevant amount using the original payment method.

5. Prices, Taxes and Charges

Prices are displayed in the currency selected or shown during checkout.

Unless otherwise stated, the total price displayed during checkout includes applicable taxes that we are required to collect. Shipping charges, duties, import taxes or other costs will be displayed or explained before you complete your purchase whenever reasonably possible.

For international orders, the recipient may be responsible for customs duties, import taxes, brokerage fees or other charges imposed by local authorities, unless checkout expressly states that these charges are included.

Currency conversions may be performed by your bank, card issuer or payment provider. We are not responsible for exchange rates or foreign transaction fees applied by third parties.

We may change our prices at any time. Price changes will not affect orders that have already been accepted.

6. Payments

Payments may be processed by third-party payment providers. By submitting payment information, you authorise us and the relevant payment provider to charge the total amount shown during checkout.

Available payment methods may vary depending on your location.

We do not guarantee that every payment method will always be available. A payment may be refused or delayed by your bank, card issuer, payment provider or fraud-prevention systems.

You remain responsible for all amounts due in connection with an accepted order.

7. Promotional Offers and Discount Codes

Promotions, discount codes, bundles, free gifts and special offers may be subject to additional conditions communicated at the time of the offer.

Unless otherwise stated:

  • Discount codes cannot be exchanged for cash.

  • Only one discount code may be used per order.

  • Offers cannot be applied retrospectively.

  • Promotions are valid only during the stated period and while stocks last.

  • Free products must be returned together with the qualifying order if the entire order is returned.

We may cancel or refuse a promotion where it has been obtained through fraud, misuse, technical error or conduct inconsistent with the stated promotional conditions.

8. Shipping and Delivery

Available shipping methods, estimated delivery times and applicable charges are displayed during checkout or in our Shipping Policy.

Delivery estimates are not guaranteed unless expressly stated otherwise. Delivery may be affected by customs processing, carrier delays, severe weather, public holidays, incorrect address information, high order volumes or other circumstances outside our reasonable control.

You are responsible for providing a complete and accurate delivery address. We are not responsible for delays or losses caused by incorrect or incomplete information supplied by you.

Where we become aware that an order cannot be shipped within the stated or legally required period, we will provide the options required by applicable law, which may include agreeing to a revised delivery date or cancelling the affected order for a refund.

Please inspect your order promptly after delivery and contact us if the parcel or product appears damaged, incomplete or incorrect.

9. Risk of Loss and Ownership

Ownership of the products transfers to you once we have received full payment.

Risk of loss or damage transfers to you when the products are delivered to you or to a person designated by you, except where applicable law provides otherwise.

Where you independently arrange for a carrier that was not offered by us, risk may transfer when the products are handed to that carrier, to the extent permitted by law.

10. Returns, Refunds and Cancellation Rights

Returns, refunds, exchanges and order cancellations are governed by our separate Refund and Returns Policy, which forms part of these Terms.

Where mandatory consumer law gives you a right to withdraw from or cancel an online purchase, that right remains unaffected by these Terms.

Depending on your country, you may be entitled to cancel an eligible online purchase within a statutory cooling-off period. Certain products may be excluded where permitted by law, including customised goods, products unsuitable for return for health or hygiene reasons once unsealed, or goods that have been used beyond what is necessary to inspect them.

Returned products must normally be sent back in accordance with the instructions in our Refund and Returns Policy.

We may reduce a refund where a product has lost value because it was handled beyond what was reasonably necessary to establish its nature, characteristics and operation, where permitted by applicable law.

Nothing in our Returns Policy limits your rights regarding products that are faulty, damaged, unsafe, incorrectly described or otherwise non-conforming.

11. Faulty or Non-Conforming Products

Products must comply with the sales contract and any mandatory legal guarantees applicable in the customer’s country.

If you receive a faulty, damaged, incomplete or incorrect product, contact us at support@luma.com and provide:

  • Your order number.

  • A description of the problem.

  • Clear photographs or video where reasonably necessary.

  • Any other information reasonably required to assess the issue.

Depending on the circumstances and applicable law, available remedies may include repair, replacement, price reduction or refund.

Any commercial warranty provided by us is additional to, and does not replace, your mandatory statutory rights.

12. Website Availability and Accuracy

We aim to keep the website available and accurate, but we do not guarantee that access will always be uninterrupted, secure or error-free.

We may temporarily suspend or restrict access for maintenance, security, updates, technical problems or circumstances outside our control.

We may correct typographical errors, inaccuracies or omissions and update website information at any time. Where an error affects an order already placed, we will contact you and provide any options required by applicable law.

13. Accounts

Where account creation is available, you are responsible for:

  • Providing accurate and current information.

  • Maintaining the confidentiality of your login details.

  • Restricting access to your account and devices.

  • Informing us promptly of suspected unauthorised use.

You are responsible for activity performed through your account unless the activity resulted from our failure to apply reasonable security measures or unless applicable law provides otherwise.

We may suspend or terminate an account used fraudulently, unlawfully or in material breach of these Terms.

14. Reviews and User Content

You may be able to submit reviews, photographs, comments or other content to the website.

You retain ownership of your content. By submitting it, you grant us a non-exclusive, worldwide, royalty-free licence to use, reproduce, adapt, publish, translate and display that content for operating and promoting LUMA, subject to applicable privacy and consumer laws.

You confirm that your content:

  • Is accurate and based on your genuine experience.

  • Does not infringe another person’s rights.

  • Is not unlawful, threatening, defamatory, discriminatory, obscene or misleading.

  • Does not contain malware, spam or unauthorised advertising.

  • Does not disclose another person’s confidential or personal information without permission.

We may remove content that breaches these Terms or applicable law. We will not suppress or manipulate genuine reviews merely because they are negative.

15. Intellectual Property

All website content, including the LUMA name, branding, logos, product photographs, graphics, videos, text, designs, software and layout, is owned by or licensed to us and is protected by applicable intellectual-property laws.

You may use the website only for personal, non-commercial shopping purposes.

Without prior written permission, you may not:

  • Copy, reproduce, republish or commercially exploit website content.

  • Use our branding, photographs or product descriptions to sell products.

  • Modify, reverse engineer or interfere with website software.

  • Remove copyright, trademark or ownership notices.

  • Create misleading associations with LUMA.

Nothing in these Terms transfers ownership of our intellectual property to you.

16. Third-Party Services and Links

Our website may contain links to or integrations with third-party services, including payment processors, delivery companies, social-media platforms, review providers and analytics services.

Third parties operate under their own terms and privacy policies. We are not responsible for third-party websites or services that we do not control, except where applicable law makes us responsible.

The inclusion of a third-party link does not necessarily constitute an endorsement.

17. Prohibited Uses

You may not use the website:

  • For any unlawful, fraudulent or abusive purpose.

  • To violate intellectual-property, privacy or other legal rights.

  • To transmit malware, harmful code or automated attacks.

  • To scrape, harvest or collect data without authorisation.

  • To interfere with the website’s operation or security.

  • To impersonate another person or provide false information.

  • To place fraudulent orders or misuse payment disputes.

  • To circumvent purchase limits or promotional restrictions.

  • To resell our products while falsely presenting yourself as an authorised LUMA distributor.

We may restrict access, cancel affected orders or take appropriate legal action in response to prohibited activity.

18. Privacy and Electronic Communications

Our handling of personal information is described in our Privacy Policy.

By placing an order, you agree to receive transactional communications relating to your purchase, including order confirmations, payment notifications, shipping updates, delivery information and customer-support messages.

Marketing communications will be sent only in accordance with applicable law. You may unsubscribe from marketing emails at any time using the link provided in the message.

19. Disclaimer of Warranties

To the maximum extent permitted by law, the website is provided on an “as available” basis.

We do not guarantee that:

  • The website will always be available or free from errors.

  • Product photographs will appear identical on every device.

  • The website will meet every individual requirement.

  • Delivery estimates will never be affected by events outside our control.

Products are supplied with the warranties and guarantees expressly stated on the website and those required by applicable law.

Nothing in these Terms excludes any warranty, guarantee or condition that cannot legally be excluded.

20. Limitation of Liability

Nothing in these Terms excludes or limits liability where doing so would be unlawful, including liability for:

  • Death or personal injury caused by negligence.

  • Fraud or fraudulent misrepresentation.

  • Intentional misconduct or gross negligence where such liability cannot be limited.

  • Defective products where mandatory product-liability law applies.

  • Breach of mandatory consumer rights.

Subject to the above, and to the maximum extent permitted by law, we will not be liable for indirect, incidental or consequential losses that were not reasonably foreseeable when the contract was formed.

Where you purchase products for business purposes, we will not be liable for loss of profits, revenue, business opportunities, goodwill or data, except where applicable law provides otherwise.

Where legally permitted, our total liability arising from a particular order will not exceed the total amount paid for that order.

These limitations do not affect remedies that cannot be restricted under applicable consumer law.

21. Indemnification

Where you use the website for business purposes, you agree to compensate us for reasonable losses, liabilities and expenses resulting from your unlawful use of the website, infringement of another party’s rights or material breach of these Terms.

This section does not apply to consumers to the extent that it would limit mandatory consumer rights or impose an unfair obligation under applicable law.

22. Events Outside Our Control

We are not responsible for delays or failures caused by events beyond our reasonable control, including natural disasters, severe weather, war, civil unrest, government action, epidemics, labour disputes, transportation disruption, customs delays, telecommunications failures, cyberattacks or widespread supply-chain interruption.

We will take reasonable steps to minimise the effect of such events and fulfil our obligations as soon as reasonably possible.

Your statutory cancellation, refund and consumer rights remain unaffected.

23. Governing Law and Disputes

These Terms and any contract formed through the website are governed by the laws of Andorra, without regard to conflict-of-law principles.

The courts of Andorra La Vella, Andorra will have jurisdiction over disputes, except where mandatory consumer law allows you to bring proceedings in the courts of your country of residence or requires another applicable jurisdiction.

Before starting formal proceedings, you agree to contact us at support@luma.com] so that we can attempt to resolve the issue informally. This does not prevent either party from seeking urgent legal relief or exercising a statutory right.

Nothing in this section deprives consumers of protections granted by mandatory laws in their habitual country of residence.

24. Changes to These Terms

We may update these Terms to reflect changes to our services, business operations, technology or legal obligations.

The updated version will be published on this page with a revised “Last updated” date.

Changes will apply prospectively and will not normally affect orders already accepted, unless the change is required by law or is more favourable to you.

Your continued use of the website after updated Terms take effect constitutes acceptance of the revised Terms, to the extent permitted by law.

25. Severability

If any provision of these Terms is found to be unlawful, invalid or unenforceable, that provision will be interpreted or limited to the minimum extent necessary, and the remaining provisions will continue in effect.

26. No Waiver

If we do not immediately enforce a provision of these Terms, this does not mean that we waive our right to enforce it later.

27. Assignment

You may not transfer your rights or obligations under these Terms without our prior written consent.

We may transfer our rights and obligations as part of a merger, restructuring, sale of business or transfer to an affiliated company, provided that this does not reduce your mandatory consumer protections.

28. Entire Agreement

These Terms, together with our Privacy Policy, Refund and Returns Policy, Shipping Policy and any additional terms presented during checkout, constitute the agreement between you and us concerning your purchase and use of the website.

If additional terms conflict with these Terms, the more specific terms will apply to the relevant service, product or promotion.
